Allegation(s):
- The Parent alleged that the District did not conduct an annual review and create an IEP within the mandated timeline. (34 CFR § 300.324(b)(1)(i)). The Parent alleged that the District failed to provide the student with a free appropriate public education from October 11, 2024 through November 15, 2024. (34 CFR § 300.101(a)). The Parent alleged that the District failed to provide an accurate IEP, which contained the recommendations of the planning and placement team. (34 CFR § 300.324(a)(6). The Parent alleged that the District prevented the Parent from meaningfully participating in PPT meetings. 34 CFR § 300.322(a)(1). The Parent alleged that the District failed to provide proper and accurate prior written notice to the Parent. 34 CFR § 300.503(a).
Conclusion(s):
- The District failed to review the Student’s IEP on an annual basis. The Student’s IEP expired on October 11, 2024, and the IEP developed from multiple annual review meetings was not finalized until October 25, 2025. The District failed to provide the student with a free appropriate public education from October 11, 2024 through November 15, 2024. The Student’s IEP expired on October 11, 2024, and a revised IEP was not implemented until November 15, 2024. The District failed to provide the Parent with an accurate IEP that included all of the recommendations made by the PPT. The District failed to make every effort to schedule the PPT meetings at a mutually agreed-upon time and place with the parent. The District failed to provide proper and accurate PWN, because the dates on the PWN did not match the dates on which the actions took place.
Corrective Action(s):
- The District was ordered to provide the student with 52 hours of compensatory education. The District was ordered to cease its practice of unilaterally requiring that PPT meetings be held within a set window of time during the school day, and shall consult with the parent for the purpose of scheduling a meeting at a mutually agreed upon time. The District shall ensure the parent is provided with written notice of any PPT meetings at least five days prior to such meeting in accordance with state and federal regulations. The District was ordered to provide the parent no less than five days prior to any PPT meeting, assessment results or other pertinent information that the PPT intends to discuss or which are expected to inform any proposed PPT recommendations. Within the first semester of the 2025-2026 school year, the District shall provide its special education administrators and staff with training regarding the district's legal obligation to ensure that IEPs are created, implemented, and revised in a timely and accurate maimer and with respect to the rights and role of parents in the PPT process, including the scheduling of PPT meetings at a mutually agreed upon time within the parameters of the school day.
