Allegation(s):

  • The Parent alleged that the Student’s placement in a District program did not provide an appropriate program to meets the student’s needs. (34 CFR § 300.101)

Conclusion(s):

  • It was concluded that the process that was followed from initial referral to reviewing/revising the student’s program several times to finally placing the student in a program that could best support his needs was an appropriate, comprehensive process and the student was appropriately placed. The district was complaint in this area. During the investigation, however, it was found that while awaiting placement, the student experienced a significant number of restrains and the district did not adhere to the “4/20” requirement. Corrective actions were issued for this.

Corrective Action(s):

  • The District shall provide training to all appropriate staff regarding the “4/20” requirement. Specifically, in the event that physical restraint or seclusion is used on a student requiring special education or a child being evaluated to determine eligibility for special education services four or more times within 20 school days, such student's PPT shall convene for the purpose of: (A) conducting or revising a functional behavioral assessment of the student; (B) creating or revising any applicable behavioral intervention plan, including, but not limited to, such student's IEP, and; (C) reviewing or revising accommodations of the IEP.
