Allegation(s):
- Failure to provide special education and related services in conformity with the Student’s IEP (34 CFR § 300.17(d))
- Failure to respond to the Parent’s request for an IEE in a timely manner (34 CFR § 300.502)
Conclusion(s):
- The District and Magnet School are in violation of 34 CFR § 300.17(d). As evidenced by the recording of the PPT meeting, the PPT proposed the following accommodations: “Separate setting for final exams in Science/Math” and “Separate setting for tests or quizzes, as needed”. The IEP created from the PPT meeting, does not list the accommodation of “Separate setting for tests, as needed”. The District indicated that at the PPT meeting, the PPT did not propose to add the accommodation of “Separate setting for tests or quizzes, as needed”, which differs from the recording of the PPT meeting. At a following PPT meeting, the following accommodation was added to the IEP: “Separate setting for all tests and quizzes AS NEEDED in All Classes”. The Student’s IEP for the period from the first PPT meeting to the following PPT meeting did not indicate the accommodation of “Separate setting for tests or quizzes, as needed” as proposed by the PPT team.
- The District and Magnet School are not in violation of 34 CFR § 300.502. The Parent requested an IEE at public expense through email and dropped off the letter to the school. The District responded to the Parent’s request for the IEE at public expense by email in a timely manner. The District has granted the Parent’s request for an IEE at public expense and has provided the Parent with a list of evaluators. The District is awaiting the Parent’s selection of an evaluator.
Corrective Action(s):
- The District and Magnet School must conduct a PPT meeting to address the following actions:
- The PPT must review the Student’s grades on tests, quizzes, and assessments for the period where the accommodation was not stated in the IEP.
- The PPT must determine which tests, quizzes, and assessments were not provided to the Student in a separate setting for this period.
- Based on this review, the PPT must provide the Student with the opportunity to retake tests, quizzes, and assessments that were not taken in a separate setting for this period, and determine which tests, quizzes, and assessments the Student will be provided with the opportunity to retake.
- On or before July 30, 2025, the District or Magnet School must provide evidence to the CSDE that the PPT meeting has occurred and that the required actions were addressed by the PPT.
