Allegation(s):

  • The Parent alleged that as of the filing of the state complaint on June 18, 2025, the District had not identified a program for the Student to attend for her extended school year (ESY) services that began on June 30, 2025, in accordance with her IEP. The Parent further alleged that the District had not yet identified a transition program for the Student to attend for the 2025-2026 school year. (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1)

Conclusion(s):

  • While the Parent was not in agreement with the District’s recommended placement for ESY services, the District did make a recommendation for placement for ESY services. The Parent’s refusal of the educational placement does not negate the fact that the District made FAPE available to the Student for ESY services. Since the filing of this complaint, the District has secured the Student’s placement for transition services for the 2025-2026 school year. Therefore, it is determined that the District did not violate 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1) as they recommended a placement for ESY services for the summer of 2025 and secured the Student’s placement for the 2025-2026 school year. No corrective action is required. Through the course of this investigation, it was noted that while PWN was provided to the Parent for the PPT meeting held on July 16, 2025, the IEP was still not available in CT-SEDS as of August 1, 2025. This investigator reached out to the District and was informed that they were waiting for the school to update information within the IEP. RCSA 10-76d-13(6) requires that a full copy of the IEP shall be sent to the parents within five days after the planning and placement team meeting to develop, review or revise the IEP. Although the District was waiting for the school to update the IEP following the PPT meeting, the District was still responsible for providing the Parent with the full copy of the IEP within five days after the PPT meeting was held. As of August 5, 2025, the IEP was finalized and provided to the Parent. Corrective action is required.

Corrective Action(s):

  • The District must review with its special education administrators working with out of district schools/programs the timeline requirements of RCSA 10-76d-13(6) and best practices to ensure the full IEP is sent to Parents within five school days after the PPT meeting. The content of the review and staff signatures and date must be sent to this investigator no later than September 30, 2025.
