Allegation(s):

  • The Complainants alleged that the District failed to provide the Student with FAPE in the least restrictive environment (LRE) in that they changed the Student’s placement from a private therapeutic high school to instruction-in-the-home while awaiting the start of services at a school refusal program. Further, the Complainants alleged that the District failed to provide the Student with FAPE in that they failed to record the Parent’s rejection of the proposed instruction-in-the-home placement and failed to provide prior written notice (PWN) of a change in placement. 34 CFR § 300.17

Conclusion(s):

  • The investigation found that for 19 school days the District did not provide FAPE in the LRE for the Student while awaiting the start of services at the school refusal program. It was concluded that the District was out of compliance with 34 CFR § 300.17. The Complainants also alleged that the Parent objected to the Student being moved to in-home tutoring instruction at the Student’s PPT meeting and that this objection went undocumented. Unfortunately, there is no manner in which to verify if the Parent made such an objection as it does not appear on any record and there is no recording or transcript of the meeting.

Corrective Action(s):

  • On or before September 30, 2026, the District shall develop a compensatory services plan, in collaboration with the Complainants, to provide the Student with 54 hours of services/support for school refusal/avoidance and 87 hours of academic tutoring.
