Allegation(s):
- The complainant alleges that the Student is not being provided the special education and related services in compliance with her individualized education program (IEP) (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1)).
Conclusion(s):
- The District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1). The District is responsible for ensuring that services are provided to students who attend community based pre-school settings. The District did not provide the Student with services in Speech/ Language or Occupational therapies from January 14, 2025 – May 14, 2025. The District provided a letter of notice to the Parent prior to the receipt of the filing of this complaint informing the Parent of the vacancy. The District accounted for the missed services. During the investigation period for this complaint, a PPT was convened, missed services were addressed and a compensatory plan was developed and memorialized within the IEP for this meeting.
Corrective Action(s):
- The District has satisfied the necessary corrections. No further action is required.
