Allegation(s):

  • The complainant alleges that the Student has been denied FAPE due to a lack of available space in a classroom within the District. 34 CFR §§ 300.323(c)(2) and 300.17(d); (RCSA) § 10-76d-1(a)(1); 34 CFR § 300.101(b) and § 300.323(b).

Conclusion(s):

  • The Student was found eligible for special education and related services and an IEP was developed by the PPT to be implemented. The Student, however, did not start school and receive the services in her IEP until 30 school days after the implementation date of the IEP. As a result, the District failed to provide the Student with 60 hours of specialized instruction, five hours of speech and language services, and five hours of occupational therapy. This is a violation. Corrective action is required. During the investigation, the District reported that it intends to offer a compensatory education plan to make up the missed services with related services being provided over the course of the remainder of the school year, and specialized instruction over the summer.

Corrective Action(s):

    1. On or before May 9, 2025, the District will provide a written offer of compensatory service to the Parent. The compensatory plan with the Parent’s agreement should be sent to this office no later than May 23,2025. The compensatory plan shall include that all of the services will be delivered prior to December 31, 2025. Documentation of the services delivered shall be sent to this investigator.
    2. If the Parent does not accept the plan offered by the District, this investigator will order a revised corrective action for the violation found in this complaint. It should be noted that during this investigation, the CSDE General Supervision team conducted a comprehensive review of Bridgeport Public School’s compliance with Indicator 12 (FAPE by Age 3). As part of the CSDE's current monitoring activities, the BSE will continue to monitor the implementation of IEPs for pre-kindergarten students residing within the District.
