Allegation(s):
- Failure to use the required criteria when determining if the Student had a specific learning disability (34 CFR § 300.311, RCSA § 10-76d-9(b)).
- Failure to complete an initial evaluation that encompasses the entire eligibility determination process within the state timeline of 45-school days (RCSA §10-76d-13).
- Failure to provide an IEP goal in planning and organization in writing that meets the Student’s educational needs that result from the Student’s disability (34 CFR § 300.320(a)(2)).
Conclusion(s):
- The District is in violation of 34 CFR § 300.311 and/or RCSA § 10-76d-9(b) because the District failed to document certain elements when determining if the Student had a specific learning disability. Corrective action is required.
- The District is not in violation of RCSA § 10-76d-13. The PPT found the Student ineligible which ended the initial timeline within the state timeline of 45-school days. No corrective action required.
- The District is not in violation of 34 CFR § 300.320(a)(2). As shown in evaluations, writing is not a need of the Student resulting from the Student’s disability and does not require an IEP goal. The Student’s IEP includes IEP goals to address the weakness in planning and organization, as well as accommodations and modifications in all classes to address this area. No corrective action required.
Corrective Action(s):
- On or before May 30, 2025, the District must provide training to all relevant staff on the documentation requirements when determining eligibility of a student suspected of having a specific learning disability. Documentation of this training and the staff that participated needs to be sent to the BSE.
- On or before February 28, 2025, the District must complete the Multidisciplinary Evaluation report (MER) for the eligibility determination PPT that was held previously. A copy of the completed MER must be sent to the Parent and uploaded to the Student’s file in CT-SEDS. A copy of the MER must also be sent to the BSE.
