Allegation(s):
- It was alleged that the District did not respond to multiple requests for an independent educational evaluation (IEE), nor provide a prompt response to the requests by filing a due process complaint or ensuring the provision of the IEE at public expense. 34 CFR § 300.502 b(2)(i) and (ii).
Conclusion(s):
- The District conducted evaluations upon which they relied to develop the IEP. One evaluation was a transition evaluation conducted by an outside provider at the District’s expense by a mutually agreed upon provider. The parent stated concerns with the transition evaluation in a Parent Concern Letter following the PPT during which the evaluation was reviewed. The Parent did not at any time request an IEE at public expense. The statements made by the Parent are vague and could reasonably be interpreted as requests for further evaluations to be conducted by the District and not requests for IEEs at public expense. Since the Parent never requested an IEE at public expense, the District did not have to file for due process or ensure that the evaluation was provided at no cost to the parent. There is no violation.
