Allegation(s):
- The complainant alleges that the Student is not being provided the special education and related services in compliance with her individualized education program (IEP) (34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1)).
Conclusion(s):
- In a letter dated June 28, 2024, the District informed the Charter School that the District was assuming the responsibilities of ensuring that the services at the Charter School were provided as mandated by the students’ IEPs. Subsequent staffing issues led to the lack of IEP services being provided to the Student and despite the District’s efforts to fill the positions at the Charter School, the District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17, RCSA § 10-76d-1(a)(1). Corrective action is required.
Corrective Action(s):
- The District must provide the Student with a compensatory education plan in the area of reading and counseling. A log must be kept of each individual service and include the date, time, length of session, service provider, and focus of the session. The CSDE must receive monthly updates on the completion of the compensatory education services.
