Allegation(s):

Failing to provide a free appropriate public education (FAPE) (34 CFR § 300.101) – failure to provide a program review, thus impacting the ability of a PPT to ensure an adequately developed IEP

Conclusion(s):

As of the filing of this complaint, the District was not in compliance with their agreement with the Surrogate Parent to complete the Student’s program review and to do it in a timely manner, thus impacting the ability to provide FAPE (34 CFR § 300.101). However, during the course of this investigation, the District completed the Student’s program review.

Corrective Action(s):

If not already provided, the District shall provide a copy of the results (i.e., a written report) of the Student’s program review to the Surrogate Parent.
The District shall convene a PPT meeting to review/revise the Student’s IEP based on the results of the program review.
