Conclusion(s):
- The District is in violation of 34 CFR Section 300.17(d) which requires that special education and related services are provided in conformity with an Individualized Education Program (IEP). The Student’s current IEP includes special education services with a special education teacher listed as the Responsible Staff/Service Implementer. The Magnet School did not provide the Student with special education services in academic services, writing, and mathematics from August 27, 2024 to now. Corrective action is required.
Corrective Action(s):
- On or before December 15, 2024, the District shall convene a meeting and facilitate the meeting activities with the Parent and the Magnet School in attendance to develop a compensatory service plan to provide the Student with programming to compensate for the special education services that were not provided from August 27, 2024 to now. The compensatory services must be provided by the Magnet School or a contracted representative of the School, unless all parties agree otherwise. Staff implementing compensatory services must be qualified to provide whichever services are described in the plan. Compensatory services described in the plan may, but are not required to, represent a one-to-one correlation of hours of missed services to hours of compensatory services. The District and Magnet School shall provide a copy of the compensatory services plan to the Bureau of Special Education.
