Allegation(s):
- Failure to provide special education services and related services in a timely way in accordance with the Student’s individualized education plan (34 CFR §§ 300.323(c)(2) and 300.17(d)), (RCSA § 10-76d-1(a)(1))
Conclusion(s):
- The District is in violation of 34 CFR §§ 300.323(c)(2) and 300.17(d), RCSA § 10-76d-1(a)(1). From the implementation date on the PWN for the IEP amended, through the date of this complaint, the Student was not provided the support of a cued speech transliterator paraprofessional in accordance with the Student’s IEP. While a paraprofessional has now been hired, training in cued speech transliteration needs to be completed.
- The Student was not provided the paraprofessional support designated in the Student’s IEP for writing, Fundations, and WINN from the start of the 2023-2024 school year through the date of this complaint. While the District was in violation, since the complaint was filed a paraprofessional has been hired to support the Student throughout his school day. No corrective action is required.
Corrective Action(s):
- The District and the Magnet School must work together to ensure that staff is trained to provide the Student with cued speech transliteration as set forth in the Student’s IEP until or unless the IEP is revised.
- No later than January 31, 2024, the Magnet School must review the Connecticut General Statute 10-246l.
