School District:
Newington Public Schools (single student)
Allegation(s):
- Failure to provide transportation as a related service that includes travel to and from school and between schools (34 CFR § 300.34(c)(16))
Conclusion(s):
- The District is not in violation 34 CFR § 300.34(c)(16). A student’s need for related services (including transportation) is determined on an individual basis as part of the IEP process. The District appropriately convened multiple PPT meetings to discuss the Parent’s concerns with transportation and their request for individual transportation as a related service in the Student’s IEP. The record shows that the PPT used and considered a variety of sources of information, including the Parent’s concerns, transportation reports, school reports of behavioral data, and the intermittent viewing of video footage from the bus when making the decision regarding the Parent’s request. At the PPT meeting, no specific evidence was presented to the team to show that the Student’s disabilities required individual transportation.
Corrective Action(s):
- No corrective actions required
