Allegation(s):

  • The District failed to conduct a comprehensive initial evaluation and failed to use a variety of assessment tools and strategies to gather relevant functional, developmental, and academic information about the child, including information provided by the parent, that may assist in determining— (i) Whether the child is a child with a disability under § 300.8. 34 CFR § 300.304(b)(1) & 34 CFR § 300.304(c)(6).

Conclusion(s):

  • The record in this investigation indicates that the District failed to conduct a sufficiently comprehensive evaluation to identify all of the child’s special education and related services needs. Specifically, the District is unable to provide any current or relevant data on the Student’s progress and present levels of performance used when determining the Student’s eligibility for special education and related services. This is a violation of 34 CFR § 300.304(b)(1) and 34 CFR § 300.304(c)(6).

Corrective Action(s):

  • The District shall convene a PPT and consider the parent’s referral to special education and request for a comprehensive evaluation. If an evaluation is recommended and the Student is found eligible for special education and related services based on the evaluation findings, compensatory services must be provided to the Student dating back to the first day of school for the 2023-2024 school year. All documentation related to the referral of this Student and any subsequent documentation and logs for compensatory education are to be submitted to this office
