Allegation(s):
- Failing to provide parents with the Procedural Safeguards Notice (34 CFR § 300.504(a))
- Failing to provide an interpreter for the parents who are in need of such services (34 CFR § 300.322 and RCSA § 10-76d-12(a)(5))
- Complainant alleged that the Parent did not have an option to bring an attorney to the Student’s September 27, 2023, PPT meeting.
Conclusion(s):
- Procedural Safeguards were provided to the Parent on September 7, 2023, which met the District’s obligation to provide such notice. It was not provided in a language other than English as the Parent neither requested nor desired it. It is concluded that the District met its obligations.
- A need for the Parent to have translation services in order to understand and actively participate in the activities becomes secondary to the Parent’s request for and desire for such services. In this case, the Parent was not denied translation services by the District, that had refused District- provided translation services multiple times.
- Parent has clearly expressed that they do not wish for the District to provide translation services nor translate written materials; instead preferring to rely on family members when assistance is required in this area. It is concluded that the District met its obligations.
