Conclusion(s):
- Due to the District’s inability to secure a paraprofessional between October 6, 2023 through November 16, 2023, the District is in violation of 34 CFR § 300.101 and RCSA § 10-76d-1. The Connecticut State Department of Education recognizes the efforts that the District took to locate a paraprofessional for the Student between the start of the school year and November 16, 2023. The District also provided the Student with a substitute paraprofessional from the start of the school year until the Parent expressed her concerns on October 5, 2023.
Corrective Action(s):
- The District is ordered to provide the Student with 3 hours of compensatory education with a special education teacher in order to compensate for the time the Student was without paraprofessional services.
- The Student’s IEP will be corrected to have paraprofessional services only associated with active goals and objectives.
