PUBLIC NOTICE

Pursuant to Regulation 310 CMR 7.00: Appendix C, notice is hereby given that the Department of Environmental Protection, (“MassDEP”) acting in accordance with the provisions of M.G.L. chapter 111, Section 142A through 142E, will offer for public comment the following draft Operating Permit (Renewal).

The draft Operating Permit (Renewal) for the Massachusetts Municipal Wholesale Electric Company – Stony Book Energy Center is being issued in accordance with 310 CMR 7.00: Appendix C(6). The purpose of the draft Operating Permit (Renewal) is to codify all of the facility's applicable requirements under the state and federal Clean Air Act, including monitoring, record keeping requirements and emission limitations, into a renewable Operating Permit. This action is required by the U.S. Environ- mental Protection Agency as stated in its final rule approving the Department's Operating Permit program (Federal Register Vol. 61, No. 95 Wednesday May 15, 1996).

The Renewal Application and draft Operating Permit Renewal are available on the EEA ePLACE Public Access Portal at https://eeaonline.eea.state.ma.us/EEA/PublicApp/. * The Renewal Application, MassDEP’s proposed decision, and the administrative record also are available for inspection at MassDEP’s Office at the above letterhead address. Comments may be submitted via the Public Access Portal, via electronic mail to marc.simpson@mass.gov, or via mail to the letterhead address above.

The Public Comment period will extend until January 14, 2024. Under the provisions of M.G.L. Chapter 30A and 310 CMR 7.00: Appendix C(6)(f), a public hearing may be requested by any person by submitting a written request to the Regional Office, stating the nature of the issues to be raised at a public hearing. Based on the written request, MassDEP will determine if a public hearing will be held, and a 30 - day written notice will be given. The duration of the public comment period shall automatically extend to the close of the public hearing as provided for at 310 CMR 7.00: Appendix C(6)(g).
