Cannabis Erasure

Because possession of cannabis is now legal, many violations can be erased from your criminal record. There are two ways to get your cannabis convictions erased, depending on the type of conviction.

Some convictions will be automatically erased. Others will require a few extra steps, including a court petition.

About Cannabis Erasure
  • Convictions for violations of General Statutes § 21a-279(c) imposed between January 1, 2000, and September 30, 2015 will be automatically erased on January 1, 2023. You don’t need to do anything to make these convictions eligible for Cannabis erasure.
  • Convictions for the following violations can be erased if you file a petition with the Court. You can file this petition with the court starting July 1, 2022.
    • Convictions for violations of General Statutes § 21a-279 for possession of less than or equal to 4 ounces of a cannabis-type substance imposed before January 1, 2000, and between October 1, 2015, and June 30, 2021.
    • Convictions for violations of General Statutes § 21a-267 (a) for possession with intent to use drug paraphernalia for cannabis imposed before July 1, 2021.
    • Convictions for violations of General Statutes § 21a-277(b) imposed before July 1, 2021, for manufacturing, selling, possessing with intent to sell, or giving or administering to another person a cannabis-type substance and the amount involved was less than or equal to 4 ounces or 6 plants grown inside your home for personal use.

  • Convictions for violations of General Statutes § 21a-279(c) imposed between October 1, 2015, and July 1, 2021 will be automatically erased on January 1, 2023.
Cannabis Convictions You Can Ask the Court to Erase With a Petition
  • Convictions for violations of General Statutes § 21a-279 for possession of less than or equal to 4 ounces of a cannabis-type substance imposed before January 1, 2000, and between October 1, 2015, and June 30, 2021
  • Convictions for violations of General Statutes § 21a-267 (a) for possession with intent to use drug paraphernalia for cannabis imposed before July 1, 2021
  • Convictions for violations of General Statutes § 21a-277(b) imposed before July 1, 2021, for manufacturing, selling, possessing with intent to sell, or giving or administering to another person a cannabis-type substance and the amount involved was less than or equal to 4 ounces or 6 plants grown inside your home for personal use
