ATTORNEY GENERAL TONG STATEMENT ON DOJ SETTLEMENT WITH HERITAGE PHARMACEUTICALS OVER GENERIC DRUG PRICE FIXING
Attorney General William Tong issued the following statement today regarding news that Heritage Pharmaceuticals has entered into a $7 million criminal and civil settlement with the U.S. Department of Justice regarding price fixing of generic drugs.
"Heritage Pharmaceuticals was part of an industry-wide conspiracy to fix prices and allocate market share, driving up the cost of prescription drugs for all Americans. Our litigation against Heritage is ongoing, and our investigation into the generic drug industry is ongoing and expanding. The companies and individuals responsible for this scheme must be held accountable," said Attorney General William Tong. "The guilty plea pertains to one drug for a limited period of time and is based off the federal sentencing guidelines. We, the State of Connecticut, believe that the civil exposure in our litigation and the liability for Heritage is much greater than that and we will continue to prosecute our case aggressively."
Connecticut and 45 other states first sued Heritage in 2016 along with 17 other corporate defendants and two individual defendants alleging a broad, industry-wide conspiracy to restrain competition and raise prices on 15 generic drugs. Two former executives from Heritage Pharmaceuticals, Jeffery Glazer and Jason Malek, have entered into settlement agreements and are cooperating with the Attorneys General working group in that case. On May 10, Connecticut and 43 other state attorneys general filed a second lawsuit against Teva Pharmaceuticals and 19 of the nation's largest generic drug manufacturers alleging a conspiracy to artificially inflate and manipulate prices, reduce competition and unreasonably restrain trade for more than 100 different drugs.
