BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Carolyn Futtner called the meeting to order at 10:08am.
Chairman Futtner read the Introductory Statement and called the roll call. Six appellants were present, five appellants failed to appear. Seven Local Issuing Authorities were present along with the State, one Local Authority failed to appear.
Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Elbert Gray, Col. Chris Lewis, and Col. Kyle Overturf,
Board Members Absent: Det. Gudrun Johnson, Chief Carl Rosensweig, and Stephen Sanetti, Esq.
Chairman Carolyn Futtner administered the oath to all witnesses.
Hearings: Eleven cases were heard in the following order:
1) Case No. 23-199-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Jeff Gilbert represented the Local Issuing Authority, Chief Paul Melanson, Avon Police Department.
Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Avon to issue the permit. Vote was 5-0 in favor of the appellant.
2) Case No. 23-202--D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief James Canon represented the Local Issuing Authority, Chief James Canon, Jr, Suffield Police Department.
Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Suffield to issue the permit. Vote was 5-0 in favor of the appellant.
3) Case No. 23-187-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. TO Matthew DaSilva represented the Local Issuing Authority, Chief C. Colin McAllister, Naugatuck Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit, at this time. Vote was 5-0 in favor of the Local Issuing Authority.
4) Case No. 22-735-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. John Iommazzo represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Withdrawal: The appellant withdrew her case.
5) Case No. 23-070-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. John Iommazzo represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Motion: Board member Dr. Conrad made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
6) Case No. 23-186-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Lt. Brian Weir represented the Local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit, at this time. Vote was 5-0 in favor of the Local Issuing Authority.
7) Case No. 23-234-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Atty. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection.
Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
8) Case No. 23-286-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Atty. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection.
Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
9) Case No. 23-263-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Paul Bertola represented the Local Issuing Authority, Chief C. Colin McAllister, Naugatuck Police Department.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
10) Case No. 23-184-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. No one represented the Local Issuing Authority, Chief Scott Todd, Derby Police Department.
Motion: Board Secretary Col. Overturf made a motion for the Appellant, by default, due to the Local Issuing Authority (Derby) failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously.
11) Case No. 22-691-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. No one represented the Local Issuing Authority, Chief Scott Todd, Derby Police Department.
Marked off: This case has been marked off due to failure on both parties to attend the hearing.
Secretary’s Report:
Board member Dr. Conrad made a motion to accept the minutes from August 29, 2024, seconded by Col. Overturf motion carried. Vote 4-0-1 to approve. Mr. Gray abstained.
