Call to Order

Chairman Carolyn Futtner called the meeting to order at 10:05am.

Chairman Futtner read the Introductory Statement and called the roll call.  Seven appellants were present, three appellants failed to appear. Seven Local Issuing Authorities were present along with the State. One Issuing Authority failed to appear. 

Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Col. Chris Lewis, Col. Kyle Overturf, and Chief Carl Rosensweig,

Board Members Absent: Elbert Gray, Det. Gudrun Johnson, and Stephen Sanetti, Esq.

Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Ten cases were heard in the following order:

1) Case No. 22-490-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department with one witness.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered Waterbury to issue the permit.   Chairman Futtner, Dr. Conrad, Col. Lewis, and Col. Overturf, voted in favor of the Appellant. Chief Rosensweig voted in favor of the Local Issuing Authority. Vote was 4-1 in favor of the appellant.

2) Case No. 22-468-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Motion: Board member Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously. Motion passed 5-0.

3) Case No. 22-599-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Motion: Board member Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Conrad, motion passed unanimously. Motion passed 5-0.

4) Case No. 22-620-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Jennifer Miller represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection.

Motion: Co. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Chief Rosensweig, motion passed unanimously. Motion passed 5-0.

5) Case No. 22-769-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf..  NO ONE represented the Local Issuing Authority, First Selectman Sal Titus, Town of Stafford.

Withdrawl: Due to the appellant having an automatic disqualifier, the appellant chose to withdraw his case. 

6) Case No. 22-613-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Jennifer Miller represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

7) Case No. 24-037-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Michael Sigrist represented the Local Issuing Authority, Chief Roderick Porter, Bridgeport Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 5-0 in favor of the Local Issuing Authority.

8) Case No. 21-810-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Joe Ficacelli represented the Local Issuing Authority, Chief Mack Hawkins, East Harford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 5-0 in favor of the Local Issuing Authority.

9) Case No. 23-553-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Joe Ficacelli represented the Local Issuing Authority, Chief Mack Hawkins, East Harford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered East Hartford to issue the permit.  Vote was 5-0 in favor of the appellant.

10) Case No. 22-742-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  . Lt. Joe Ficacelli represented the Local Issuing Authority, Chief Mack Hawkins, East Harford Police Department.

Motion: Board member Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Conrad, motion passed unanimously. Motion passed 5-0.

 

Secretary’s Report:

Board member Col. Lewis made a motion to accept the minutes from January 18, 2024, seconded by Dr. Conrad. motion carried. Vote 5-0 to approve.
