BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Acting Chairman Stephen Sanetti called the meeting to order at 10:04am.

Acting Chairman Stephen Sanetti read the Introductory Statement and called the roll call.  Two appellants were present, three appellants failed to appear. Two Local Issuing Authorities were present along with the State.

Board Members Present: Stephen Sanetti, Esq. Dr. Cynthia Conrad, Elbert Gray, Det. Gudrun Johnson, Col. Kyle Overturf, and Chief Carl Rosensweig, 

Board Members Absent: Carolyn Futtner, Esq. and Col. Chris Lewis

Acting Chairman Stephen Sanetti administered the oath to all witnesses.

Hearings: Five cases were heard in the following order:

1) Case No. 23-142-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Jennifer Miller represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

2) Case No. 22-884-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Jennifer Miller represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously

3) Case No. 23-021-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Sgt. John Iommazzo represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Mr. Gray, Det. Johnson, Col. Overturf, and Chief Rosensweig in favor of the Local Issuing Authority.  Dr. Conrad and Atty. Sanetti voted in favor of the Appellant. Vote was 4-2 in favor of the Local Issuing Authority.

4) Case No. 23-149-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Dennis Picheco represented the Local Issuing Authority, First Selectman Jeff Manville, Town of Southbury.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously

5) Case No. 23-137-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Jennifer Miller represented the State Issuing Authority, Commissioner Ronnell A. Higgins, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion to continue this case due to the appellant not receiving his hearing notice, seconded by Det. Johnson with no objection from the state, this case has been continued to September 26, 2024.

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from July 25, 2024, seconded by Mr. Gray. motion carried. Ms. Johnson abstained. Vote 5-0-1 to approve.

New Business: Motion to reopen 23-098-D made by Col. Overturf, seconded by Dr. Conrad. Motion carried. 

 

Case 22-888-R was denied reopening as the tracking was verified that it was delivered to Atty. Mowad’s office. 

 

Adjournment: Board member Conrad made a motion to adjourn seconded by Board member Gray, motion carried. Meeting ended at 11:37pm.
