Call to Order
Chairman Carolyn Futtner called the meeting to order at 10:06am.
Chairman Futtner read the Introductory Statement and called the roll call. Five appellants were present, five appellants failed to appear. Six Local Issuing Authorities were present along with the State.
Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad, Elbert Gray, Col. Kyle Overturf, Chief, Carl Rosensweig, and Stephen Sanetti, Esq.
Board Members Absent: Det. Gudrun Johnson and Col. Chris Lewis
Chairman Carolyn Futtner administered the oath to all witnesses.
Hearings: Ten cases were heard in the following order:
1) Case No. 22-579-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Christopher Massey represented the Local Issuing Authority, Chief Christopher Massey, Guilford Police Department.
Withdrawal: The appellant withdrew his case.
2) Case No. 22-317-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Captain Alex Gianonne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his case with an agreement.
3) Case No. 22-324-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Captain Alex Gianonne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his case.
4) Case No. 21-810-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman. DESPP Captain Alex Gianonne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 6-0 in favor of the State Issuing Authority.
5) Case No. 22-448-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously 6-0.
6) Case No. 22-578-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Stephen Jacques represented the Local Issuing Authority, Chief Karl Jacobson, New Haven Police Department.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously 6-0.
7) Case No. 22-494-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Town Counsel Mary Pokorski represented the Local Issuing Authority, Chief Matthew Marino, New Britain Police Department with one witness.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously 6-0.
8) Case No. 22-545-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant and his attorney failed to appear. Town Counsel Mary Pokorski represented the Local Issuing Authority, Chief Matthew Marino, New Britain Police Department with one witness.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously 6-0.
9) Case No. 21-778-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant and his attorney failed to appear. DESPP Captain Alex Gianonne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Mr. Gray, motion passed unanimously 6-0.
10) Case No. 22-137-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Gregory J. Miller. Deputy Chief Kraig Gray represented the Local Issuing Authority, Chief James Heavey, Greenwich Police Department.
Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Greenwich to issue the permit. Vote was 6-0 in favor of the appellant.
Secretary’s Report:
Board member Atty. Sanetti made a motion to accept the minutes from October 5, 2023, seconded by Dr. Conrad. motion carried. Chief Rosensweig abstained. Vote 5-0-1 to approve.
