Call to Order

Chairman Futtner called the meeting to order at 10:05am.

Chairman Futtner swore in new member, Mr. Elbert L. Gray, III.

Chairman Futtner read the Introductory Statement and called the roll call.  Ten appellants were present, three appellants failed to appear. Five local Issuing Authorities were present along with the State.

Board Members Present: Chairman Carolyn Futtner, Esq., Mr. Elbert Gray, III, Col. Chris Lewis, Col. Kyle Overturf, Chief Carl Rosensweig, and Stephen Sanetti, Esq.

Board Members Absent: Dr. Cynthia Conrad and Ms. Gudrun Johnson

Chairman Futtner administered the oath to all appellants and witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 22-140-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Clifford Hill represented the Local Issuing Authority, Chief Kevin Glenn, North Haven Police Department.

Withdrawal: The appellant withdrew his case.

Case No. 23-212-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Douglas J. Lewis, Esq.  Town Council Steven Stafstrom and Chief Marc O’Donnell represented the Local Issuing Authority, Chief Marc O’Donnell, Redding Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote 6-0 in favor of the Local Issuing Authority, at this time. 

3) Case No. 21-614-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously.

4) Case No. 21-585-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously.

5) Case No. 20-522-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Col. Lewis, motion passed unanimously.

6) Case No. 21-601-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Col. Overturf made a motion for the State Issuing Authority due to a “no weapon” active probation” still in place. The motion was seconded by Chief Rosensweig, the motion passed unanimously. Vote was 6-0 in favor of the State Issuing Authority.

7) Case No. 21-486-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 6-0 in favor of the State Issuing Authority.

8) Case No. 21-567-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 6-0 in favor of the State Issuing Authority.

9) Case No. 21-724-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman with one witness. Sgt. Kristopher Matthews represented the Local Issuing Authority, Chief Gerald Narowski, Derby Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Derby to issue the permit.  Vote was 6-0 in favor of the appellant.

10) Case No. 21-164-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 6-0 in favor of the State Issuing Authority.

11) Case No. 22-179-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness.  Tpr. Kevin Eklund represented the Local Issuing Authority, TFC Kevin Eklund, Town of Tolland with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote 6-0 in favor of the Local Issuing Authority. 

12) Case No. 22-017-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Jon Femia represented the Local Issuing Authority, Chief Timothy Shaw, Stamford Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote 6-0 in favor of the Local Issuing Authority. 

13) Case No. 21-443-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the state to reissue.  Mr. Gray, Col. Lewis, Col. Overturf, and Atty. Sanetti voted in favor of the Appellant. Chairman Futtner and Chief Rosensweig voted in favor of the State Issuing Authority. Vote was 4-2 in favor of the appellant.

 

Secretary’s Report:

Board member Col. Lewis made a motion to accept the minutes from March 9, 2023, seconded by Col. Overturf, motion carried. 5-0-1 to approve.
