Call to Order

Chairman Carolyn Futtner called the meeting to order at 10:03am.

Chairman Futtner read the Introductory Statement and called the roll call.  Ten appellants were present, two appellants failed to appear. Six local Issuing Authorities were present along with the State.

Board Members Present: Chairman Carolyn Futtner, Esq., Dr. Cynthia Conrad,  Elbert Gray,  Gudrun Johnson, Col. Kyle Overturf, Chief Carl Rosensweig, and Stephen Sanetti, Esq.

Board Members Absent: Col. Chris Lewis

Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Twelve cases were heard in the following order:

1) Case No. 21-867-SD, involving the State Denial of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the state to reissue.   Chairman Futtner, Dr. Conrad, Mr. Gray, Col. Overturf and Atty. Sanetti voted in favor of the Appellant. Ms. Johnson and Chief Rosensweig voted in favor of the Local Issuing Authority. Vote was 5-2 in favor of the appellant.

2) Case No. 21-843-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman.  Sgt. Kristopher Matthews represented the Local Issuing Authority, Chief Scott Todd, Derby Police Department.

Withdrawal: The appellant withdrew his case, the appellant will reapply.

3) Case No. 22-083-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Harrison Formiglio represented the Local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Withdrawal: The appellant withdrew his case.

 

4) Case No. 21-875-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

THIS CASE IS PUT ON HOLD TO DISCUSS WITH SLFU.

 

5) Case No. 22-371-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. William Bernabucci represented the Local Issuing Authority, Chief William Baldwin, Torrington Police Department.

Withdrawal: The appellant withdrew his case.

6) Case No. 22-349-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Paul Neves represented the Local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.

Withdrawal: The appellant withdrew his case.

7) Case No. 23-367-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Karen Krasicky represented the Local Issuing Authority, Chief Karen Krasicky, Plymouth Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 7-0 in favor of the Local Issuing Authority.

 

4) Case No. 21-875-R

Withdrawal: After speaking with SLFU, the appellant withdrew his case.

 

8) Case No. 21-861-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

9) Case No. 21-442-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

10) Case No. 22-352-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Captain Sean Grant represented the Local Issuing Authority, Chief William Darby, Manchester Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 7-0 in favor of the Local Issuing Authority.

11) Case No. 21-878-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

12) Case No. 21-880-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Matt Reed represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Decision: By a majority decision, the Board voted in favor of the State Issuing Authority, at this time. Chairman Futtner, Mr. Gray, Ms. Johnson, Col. Overturf, Chief Rosensweig and Atty. Sanetti voted in favor of the State Issuing Authority. Dr. Conrad voted in favor of the appellant. Vote was 6-1 in favor of the State Issuing Authority.

 

Secretary’s Report:

Board member Dr. Conrad made a motion to accept the minutes from May 25, 2023, seconded by Mr. Gray, motion carried. Ms. Johnson and Col. Overturf abstained. Vote 5-0-2 to approve the minutes.
