Call to Order

Chairman Carolyn Futtner called the meeting to order at 10:04am.

Chairman Futtner read the Introductory Statement and called the roll call.  Twelve appellants were present, one appellant failed to appear. Six local Issuing Authorities were present along with the State.

Board Members Present: Chairman Carolyn Futtner, Esq. Col. Chris Lewis, Col. Kyle Overturf, Chief Carl Rosensweig, and Stephen Sanetti, Esq.

Board Members Absent: Dr. Cynthia Conrad, Elbert Gray, and Gudrun Johnson, 

Chairman Carolyn Futtner administered the oath to all witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 21-852-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Director Attorney Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Withdrew: Appellant withdrew, state will reinstate.

2) Case No. 22-375-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Marshall Porter represented the Local Issuing Authority, Chief Marshall Porter, Glastonbury Police Department.

Withdrew: Appellant withdrew, Glastonbury will issue.

3) Case No. 22-282-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf..  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Withdrew: Appellant withdrew his case, Waterbury will issue the permit.

4) Case No. 21-854-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Richard P. Lawlor, Esq. DESPP Legal Staff Attorney Kate Ayers, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness (AP).

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

AFTER CASE 22-282-D WAS PUT ON HOLD….

3) Case No. 22-282-D

Withdrew: After corrective measures were taken, the appellant withdrew his case, Waterbury will issue the permit.

5) Case No. 22-065-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Colin Milne represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 5-0 in favor of the State Issuing Authority. 

6) Case No. 22-018-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear on his own behalf. DESPP Legal Staff Attorney Kate Ayers, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear, motion was seconded by Chief Rosensweig, motion passed unanimously

7) Case No. 22-294-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 5-0 in favor of the Local Issuing Authority.

8) Case No. 21-894-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Robert P. Pickering, Esq. DESPP Legal Staff Attorney Colin Milne, Esq. represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Withdrew: Appellant withdrew her case.

9) Case No. 22-238-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Vote was 5-0 in favor of the Local Issuing Authority.

 

10) Case No. 21-825-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted in favor of the State Issuing Authority. Chairman Futtner Col. Lewis, Col. Overturf and Chief Rosensweig and voted in favor of the State Issuing Authority. Atty. Sanetti voted in favor of the Appellant. Vote was 4-1 in favor of the State Issuing Authority.

11) Case No. 22-348-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Det. Justin Hilchuk represented the Local Issuing Authority, Chief Rafael Medina, Wethersfield Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Wethersfield to issue the permit.  Vote was 5-0 in favor of the appellant.

12) Case No. 23-397-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Staff Attorney Kate Ayers represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Vote was 5-0 in favor of the State Issuing Authority. 

13) Case No. 22-216-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by John C. Drapp, Esq.   Det. Jason Aklin represented the Local Issuing Authority, Chief Joseph Perno, West Haven Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Wethersfield to issue the permit.  Vote was 5-0 in favor of the appellant.

 

Secretary’s Report:

Board Secretary Col. Overturf made a motion to accept the minutes from June 8, 2023, seconded by Atty. Sanetti. motion carried. Col. Lewis abstained. Vote 4-0-1 to approve.
