Call to Order

Acting Chairman Carolyn Futtner Esq. called the meeting to order at 10:15am.

Acting Chairman Carolyn Futtner read the Introductory Statement and called the roll call.  Nine appellants were present, four appellants failed to appear. Nine local Issuing Authorities and the State were present, one failed to appear.

Board Members Present: Secretary, Carolyn Futtner Esq., Dr. Cynthia Conrad, Anthony Iaconis, Esq.(remote), Gudrun Johnson, Col. Chris Lewis (remote) Chief Carl Rosensweig (remote) and Stephen Sanetti, Esq.

Board Members Absent: Chairman Frank P. Blando

Acting Chairman Carolyn Futtner Esq. administered the oath to all witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 21-592-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Alaric Fox represented the Local Issuing Authority, Chief Alaric Fox, Enfield Police Department.

Withdrew: The appellant withdrew his case.

2) Case No. 21-325-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.with one witness. Chief Alaric Fox represented the Local Issuing Authority, Chief Alaric Fox, Enfield Police Department with two witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

3) Case No. 20-416-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Director Attorney Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrew: The appellant withdrew his case.

4) Case No. 21-532-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Ofc. Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Motion: Board Member Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously.

5) Case No. 20-368-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. DESPP Legal Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board member Jonson made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Conrad, motion passed unanimously.

6) Case No. 21-593-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Motion: Board Member Johnson made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Sanetti, motion passed unanimously.

7) Case No. 20-356-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. DESPP Legal Director Cynthia Isales represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Continuance: This case has been continued to September 1, 2022

8) Case No. 21-647-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.with one witness.  Lt. Matthew Rendeau represented the Local Issuing Authority, Chief Robert Kalamaras, Fairfield Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered Fairfield to issue the permit..  Dr. Conrad, Atty. Ioconis and Col. Lewis and Atty. Sanetti voted in favor of the appellant.  Acting Chairman Futtner, Ms. Johnson and Chief Rosenweig voted in favor of the Local Issuing Authority. Vote was 4-3 in favor of the appellant.

9) Case No. 21-613-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

 

Atty. Iaconis left the hearing during this case and did not vote. 

Decision: By a majority decision, the Board voted to uphold the Local Issuing Authority the denial of his permit. Dr. Conrad, Col. Lewis, Chief Rosensweig and Atty. Sanetti voted in favor of the Local Issuing Authority.  Acting Chairman Futtner and Ms. Johnson voted in favor of the appellant. Vote was 4-2 in favor of the Local Issuing Authority.

10) Case No. 21-631-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.

Continuance: This case has been continued to June 23, 2022

11) Case No. 21-571-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Det. Leopold Clarke represented the Local Issuing Authority, Chief Justin Thody, Hartford Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant. Acting Chairman Futtner, Dr. Conrad, Ms. Johnson, Col. Lewis, and Atty. Sanetti voted in favor of the appellant.  Chief Rosensweig voted in favor of Local Issuing Authority. Vote was 5-1 in favor of the appellant.

12) Case No. 21-682-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Cpt. Andrew Power represented the Local Issuing Authority, Chief Donald Melanson, Windsor Police Department.

Withdrew: The appellant withdrew his case.

13) Case No. 21-576-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.  A representative failed to appear for the Local Issuing Authority, Chief Patrick Deely, Middlebury Police Department.

Marked off:  This case has been marked off due to no one showing for hearing.
