BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Five appellants were present, Three appellants failed to appear. Five local Issuing Authorities and the State were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., and Gudrun Johnson and Chief Carl Rosensweig

Board Members Absent: Mr. M. Peter Kuck

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Four cases were heard in the following order:

1) Case No. 20-200-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his case

2) Case No. 19-287-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.   Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with three witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

11:15 Chief Rosensweig joined in on the hearing.

3) Case No. 20-146-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Christian DeCarlo represented the Local Issuing Authority, Chief Timothy Shaw, Stamford Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time. Chairman Blando, Secretary Overturf, Dr. Conrad, Atty. Futtner, Ms. Johnson and Chief Rosensweig voted in favor of the Local Issuing Authority. Atty. Ioconis voted in favor of the Appellant.

4) Case No. 20-566-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Cpt. Andrew Power represented the Local Issuing Authority, Chief Donald Melanson, Windsor Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

 

5) Case No. 19-341-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Board Secretary Overturf recused himself from this case.

6) Case No. 20-305-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Chief Rosensweig, motion passed unanimously.

7) Case No. 20-502-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Iaconis, motion passed unanimously.

8) Case No. 20-140-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Joseph Legen represented the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.

Decision: By a unanimous decision, the Board voted to in favor of the appellant and ordered Stratford to issue the permit.

 

 

Secretary’s Report:

Dr. Conrad made a motion to accept the minutes from February 11, 2021, seconded by Atty. Futtner, motion carried. Board Secretary Overturf and Atty. Iaconis abstained from the vote.

New Business:

 

Discussed the backlog with numbers of denials and revocations.

 

Also discussed in person hearings. Will revisit this topic in April or May.

 

Adjournment: Board Secretary Overturf made a motion to adjourn, seconded by Chief Rosensweig, motion carried. Meeting ended at 12:40 pm.
