Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Four appellants were present, two appellant failed to appear. One attorney requested a continuance for his client who was not present. Five local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Board Secretary Col. Kyle Overturf, Dr. Cynthia Conrad,  Carolyn Futtner Esq., Anthony Iaconis, Esq., and Ms. Gudrun Johnson.

Board Members Absent: Chief Carl Rosensweig and Mr. M. Peter Kuck

Hearings: Seven cases were heard in the following order:

1) Case No. 21-312-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Chief James Kenny represented the Local Issuing Authority, Chief James Kenny, Vernon Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. Chairman Blando, Secretary Overturf, Atty. Futtner, and Ms. Johnson voted in favor of the Local Issuing Authority. Dr. Conrad and Atty. Ioconis voted in favor of the Appellant. Vote 4-2 in favor of the Issuing Authority.

2) Case No. 20-133-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant’s attorney came onto Teams and requested a continuance. The continuance was granted and the new date is May 20, 2021.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Continuance: Case 20-133-R has been continued to May 20, 2021.

3) Case No. 21-151-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Craig C. Fishbein, Esq..  Det. William DeGoursey represented the Local Issuing Authority, Chief John Drumm, Madison Department of Police Services.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Madison to issue the permit.

 

4) Case No. 18-509-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Atty. Iaconis, motion passed unanimously.

5) Case No. 20-351-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.   Sgt. Avery Marsh represented the Local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Ms. Johnson, motion passed unanimously.

12:05pm Dr, Conrad left the hearing.

6) Case # 20-366-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Matthew Clerkin represented the Local Issuing Authority, Chief Jonathan Mulhern, Branford Police Department.

Withdrew: The appellant withdrew his case.

7) Case No. 20-484-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Ofc. Dennis Putnam represented the Local Issuing Authority, Chief John Sullivan, Hamden Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Hamden to issue the permit.

 

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from January 7, 2021, seconded by Ms. Johnson, motion carried.
