BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order
Chairman Frank P. Blando called the meeting to order at 10:00am.
Chairman Blando read the Introductory Statement and called the roll call. Eight appellants were present, six appellants failed to appear. The State Issuing Authority and six Local Issuing Authorities were present.
Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Dr. Cynthia Conrad, Carolyn Futtner Esq., Mr. M. Peter Kuck and Chief Carl Rosensweig.
Board Members Absent: Anthony Iaconis, Esq. and Gudrun Johnson.
Chairman Frank P. Blando administered the oath to all witnesses.
Hearings: Fourteen cases were heard in the following order:
1) Case No. 20-052-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Kenneth Keroack represented the Local Issuing Authority, Chief Fernando Spagnolo, Waterbury Police Department.
Withdrawal: The appellant withdrew his case.
2) Case No. 18-509-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Continued: This case has been continued for 6 months with stipulated agreement. June 4, 2020 is new date.
3) Case No. 20-037-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Richard Brown represented the Local Issuing Authority, Chief Richard Brown, Suffield Police Department.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.
4) Case No. 19-016-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Michael Evangelisti represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously. Atty. Futtner recused herself in this case.
5) Case No. 18-636-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
6) Case No. 18-589-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
7) Case No. 18-012-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

8) Case No. 18-472-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Motion: Board Secretary Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
9) Case No. 19-572-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his case, state will reissue.
10) Case No. 19-544-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legen present for the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.
Motion: Board Secretary Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.
11) Case No. 19-721-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Atty. John Diakun appeared for the Local Issuing Authority, Chief Christopher Chute, New Britain Police Department with one witness.
Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.
12) Case No. 20-050-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Lionel Rodriguez appeared for the Local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.
Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Bloomfield to issue the permit.
13) Case No. 18-645-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.
Withdrawal: The appellant withdrew his case.
14) Case No. 20-031-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Joseph Legen present for the Local Issuing Authority, Chief Joseph McNeil, Stratford Police Department.
Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered Stratford to issue the permit.
Secretary’s Report:
Board Secretary Overturf made a motion to accept the minutes from November 14, 2019, seconded by Dr. Conrad, motion carried.
New Business:
Board Secretary Overturf made a motion to go into Executive Session to discuss Case 17-723-D, seconded by Board member Kuck.
Board Secretary Overturf made a motion to come out of Executive Session, seconded by Board member Kuck.
Office Manager was instructed to proceed with what was spoken of in Executive Session.
Adjournment: Board member Kuck made a motion to adjourn. Seconded by Board Secretary Overturf motion carried. Meeting ended at 12:45pm.
