BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, October 18, 2018, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, one appellant failed to appear and two cases were resolved the day before the hearing. The State Issuing Authority and six local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Dr. William Sledge, Chief Carl Rosensweig and Gudrun Johnson.

Board Members Absent: Mr. M. Peter Kuck.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Sixteen cases were heard in the following order:

1) Case No. 17-681-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Marked off: The State has agreed to issue the permit.

2) Case No. 16-580-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Marked off: The State has agreed to issue the permit.

3) Case No. 17-661-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit.

4) Case No. 16-332-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Adam D. Meltsner Esq. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Continued: This case has been continued to December 6, 2018.

5) Case No. 16-420-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief James Kenny was present for the local Issuing Authority, Chief James Kenny, Vernon Police Department with one witness.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

6) Case No. 18-350-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Isaias Diaz, Esq. Sgt. Keroack represented the local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

7) Case No. 17-649-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D Sherman, Esq.. Patrolman Andre Rosedale was present for the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Withdraw: This case has been withdrawn due to an agreement with the Norwich Police Department.

8) Case No. 18-035-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D Sherman, Esq.. Officer James McKeown appeared for the Local Issuing Authority, Chief Paul Melanson, Farmington Police Department with 2 witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit.

9) Case No. 18-007-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Keroack represented the local Issuing Authority, Acting Chief Fernando Spagnolo, Waterbury Police Department.

Withdrew: The appellant withdrew his case.

10) Case No. 17-755-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. . Tpr. Eklund appeared for the local Issuing Authority, Town Manager Steven Werbner, Town of Tolland.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

Board Secretary Col. Kyle Overturf left the meeting at 2:00pm

11) Case No. 17-170-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Atty. Duncan Forsyth appeared for the local Issuing Authority, First Selectman, Theodore Shafer, Town of Burlington with 3 witnesses.

Decision: By a unanimous decision, the Board voted in favor of the appellant and instructed Burlington to issue the permit.

12) Case No. 18-027-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Captain Berry represented the local Issuing Authority, Chief James Heavey,  Greenwich Police Department.

Decision: By a majority vote, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. .Board member Dr. Sledge voted in favor of the appellant and Chairman Blando, Chief Rosensweig, Gudrun Johnson and Attorney Futtner voted in favor of the Issuing Authority.

13) Case No. 17-685-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Lt. Joseph LaRose represented the local Issuing Authority, Chief Patrick Ridenhour, Dabury Police Department.

Decision: By a majority vote, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. .Board member Gudrun Johnson voted in favor of the appellant and Chairman Blando, Chief Rosensweig, Dr. Sledge and Attorney Futtner voted in favor of the Issuing Authority.

14) Case No. 17-540-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf.  Det. Joshua Kyle represented the local Issuing Authority, Chief Anthony Campbell, New Haven Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit at this time.

14) Case No. 18-077-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Massicotte. represented the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department with 2 witnesses.

Decision: By a majority vote, the Board voted to uphold the decision of the Local Issuing Authority, the denial of the pistol permit. .Board member Gudrun Johnson voted in favor of the appellant and Chairman Blando, Chief Rosensweig, Dr. Sledge and Attorney Futtner voted in favor of the Issuing Authority.

Secretary’s Report:

Board member Dr. Sledge made a motion to approve the minutes of October 4, 2018 seconded by Ms. Johnson, motion carried. 

Adjournment: Board member Johnson made a motion to adjourn, seconded by Atty. Futtner, motion carried unanimously. Meeting ended at 4:30pm.
