BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando presented a proclamation to retired Col. Kyle Overturf on his 32 years of State service.

Chairman Blando read the Introductory Statement and called the roll call.  Seven appellants were present, nine appellant failed to appear. The State Issuing Authority and eleven local Issuing Authorities were present and two failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Dr. William Sledge, and Mr. M. Peter Kuck.

Board Members Absent: Chief Carl Rosensweig and Gudrun Johnson

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Sixteen cases were heard in the following order:

1) Case No. 17-059-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Krodel represented the local Issuing Authority, Chief Brett Mahoney, Waterford Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

2) Case No. 17-420-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

3) Case No. 17-395-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Dr. Sledge, motion passed unanimously.

4) Case No. 17-326-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

5) Case No. 17-535-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.  Sgt. Peperni represented the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Decision: By a majority decision, the Board voted in favor of the appellant and ordered the local Issuing Authority to issue the temporary pistol permit. Chairman Blando and Dr. Sledge voted against the appellant, Col. Overturf, Atty. Futtner and Mr. Kuck voted in favor of the appellant.

6) Case No. 17-498-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. No one was present for the local Issuing Authority, Chief Kevin Hale, Ansonia Police Department.

Decision: This case has been marked off.

7) Case No. 17-269-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. No one was present for the local Issuing Authority, First Selectman Craig Nelson, Town of Warren.

Decision: This case has been marked off.

8) Case No. 17-671-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Buckley appeared for the local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

9) Case No. 18-071-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Det. Buckley appeared for the local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Sledge, motion passed unanimously.

10) Case No. 17-579-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Off. Krodel appeared for the local Issuing Authority, Chief Brett Mahoney, Waterford Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

11) Case No. 16-378-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Peperni appeared for the local Issuing Authority, Chief Patrick Daley, Norwich Police Department.

Motion: Secretary Col. Overturf made a motion for the Local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Dr. Sledge, motion passed unanimously.

12) Case No. 17-693-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Buckley represented the local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Motion: Secretary Col. Overturf made a motion for the local Issuing Authority do to the appellant moving to Bridgeport. Board member Kuck seconded the motion, motion passed unanimously.

13) Case No. 17-150-D, involving the denial of a temporary pistol permit to carry pistols and revolvers.  The appellant was represented by Attorney Ralph D. Sherman. Lt. Heather Desmond represented the local Issuing Authority, Chief William McKenna, Middletown Police Department.

Decision: By a majority decision, the Board voted to uphold the decision of the Issuing Authority the denial of the temporary permit.  Col. Overturf and Atty. Futtner voted in favor of the appellant.  Chairman Blando, Dr. Sledge and Mr. Kuck voted against the appellant.

14) Case No. 17-640-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Sgt. Marcus represented the local Issuing Authority, Chief Patrick Ridenhour, Danbury Police Department.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

15) Case No. 17-722-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Jason Sucall.  Joseph Skully represented the local Issuing Authority, Chief James Wardwell, New Britain Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, the denial of the pistol permit.

16) Case No. 18-284-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Off. Caserta represented the local Issuing Authority, Chief Jonathan Fontneau, Stamford Police Department.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered the local Issuing Authority to issue the temporary pistol permit.

Secretary’s Report:

Board Secretary Col. Overturf made a motion to table the minutes from June 21, 2018 as copies were not put in packet, seconded by Board member Kuck, motion carried.
