BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Frank P. Blando did the swearing in of Attorney Carolyn M. Futtner, new public member appointed by Governor Dannel Malloy.

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Ten appellants were present, one appellant failed to appear. The State Issuing Authority and seven local Issuing Authorities were present, two failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Chief Carl Rosensweig, Dr. William Sledge, and Carolyn Futtner, Esq.

Board Members Absent: Ms. Gudrun Johnson and Mr. M. Peter Kuck

Chairman Frank P. Blando administered the oath to all witnesses.

Due to the lack of quorum we continued the meeting until the needed Board member arrived at 11:00am.

Hearings: Eleven cases were heard in the following order:

1) Case No. 16-554-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Atty. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witnesses.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 17-021-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appeared on his own behalf.  A representative failed to appear for the local Issuing Authority, Chief Jeffery Finch, Bethel Police Department.

Withdrawal: Due to the appellant having a handgun misdemeanor disqualifier the appellant withdrew his

appeal.

3) Case No. 17-011-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Chief Michael Metzler was present for the local Issuing Authority, Chief Michael Metzler, Seymour Police Department with one witness.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 16-596-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Brandan Marschner represented the local Issuing Authority, Chief Keith Mello, Milford Police Department.

Motion: Board Member Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Dr. Sledge, motion passed unanimously.

5) Case No. 17-012-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Cpt. Jeff Golden appeared for the local Issuing Authority, Chief Carl Sferrazza, Enfield Police Department with one witness.

Withdrawal: The appellant withdrew his appeal.

6) Case No. 17-048-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Ralph D. Sherman.  No one appeared for the local issuing authority, Chief  Joseph McNeil, Stratford Police Department.

Motion: Board Member Overturf made a motion in favor of the appellant based on the failure of the Issuing Authority to appear, motion was seconded by Board Member Futtner Motion carries 4-0-1 abstention. Chairman Atty. Blando, Secretary Col. Overturf, Chief Rosensweig, and Atty. Futtner voted in favor of the appellant and Dr. Sledge abstained.

7) Case No. 16-552-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Atty. Doug Sauve represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted in favor of the appellant and ordered the state to reissue the permit.

8) Case No. 16-389-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Jeff Gilbert represented the local Issuing Authority, Chief Mark Rinaldo, Avon Police Department.

Motion: Board Member Overturf made a motion in favor of the appellant, seconded by Dr. Sledge. Motion carried unanimously.

9) Case No. 17-084-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Off. Robert Suchecki represented the local Issuing Authority, First Selectman Art Shilosky, Town of Colchester.

Withdrawal: The appellant withdrew his appeal.

10) Case No. 16-489-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Attorney Rachel Baird.  Sgt. Glen Howard represented the local Issuing Authority, Chief J. Darren Stewart, Stonington Police Department.

Withdrawal: The appellant withdrew his appeal.

11) Case No. 17-127-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Bensey represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Withdrawal: The appellant withdrew his appeal.

Secretary’s Report:

Board member Col. Overturf made a motion to accept the November 30, 2017 minutes as submitted, Dr. Sledge seconded the motion, motion carried unanimously. Attorney Futtner abstained.

Adjournment: Board Member Col. Overturf made a motion to adjourn, Board Member Chief Rosensweig seconded the motion, motion carried. Atty. Futtner abstained.  Meeting ended at 12:40pm.
