BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, March 9, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, two appellant failed to appear. The State Issuing Authority and six local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Esq., Dr. Charles Dike, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: No Board members absent.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Eight were heard in the following order:

1) Case No. 15-335-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Attorney John Andreini. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with four witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit at this time.

2) Case No. 15-481-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Claudio appeared for the local Issuing Authority, First Selectman, Lisa Pellegrini, Town of Somers.

Motion: Board Member Greer made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Kuck, motion passed unanimously.

3) Case No. 15-376-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

4) Case No. 15-068-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Kuck made a motion not to discuss physical abilities in this case. Motion failed.

Decision: By majority decision, the Board decided to find in favor of the appellant. .Chairman Blando, Secretary Overturf, and Board member Kuck voted in favor of the appellant.  Board members Rosensweig and Johnson voted against the appellant. Mr. Greer recused himself.

5) Case No. 16-110-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant along with the local Issuing Authority, Mansfield Sgt. Richard Counoyer left after Det. Tassanari .agreed to enter a withdrawl for them due to Mansfield issuing the permit to the appellant.

Withdrawal: The appellant withdrew his appeal.

6) Case No. 16-091-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.  Sgt. Jeff Foran represented the local Issuing Authority, Chief Marc Montminy, Manchester Police Department.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 15-365-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

8) Case No. 16-080-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Weisgerber appeared for the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Motion: Board Member Greer made a motion for the Issuing Authority seconded by Rosensweig, vote taken but did not pass. Motion failed.

Withdrawal: The appellant withdrew his appeal.

9) Case No. 15-183-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

10) Case No. 16-097-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Weisgerber appeared for the local Issuing Authority, Chief Thomas Kulhawik, Norwalk Police Department.

Decision: The Board voted unanimously in favor of the appellant and instructed the local Issuing Authority to issue the permit.

11) Case No. 17-209-CD, involving the pending decision of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Monahan appeared for the local Issuing Authority, Chief Vernon Riddick, Waterbury Police Department.

Motion: Board Secretary Col. Overturf made a motion for the appellant. Board member Johnson seconded the motion, it passed unanimously,

Secretary’s Report:

Secretary Overturf made a motion to accept the January 26, 2017 minutes as submitted, Board Member Johnson seconded the motion, motion carried. Board Member Kuck abstained.

Motion: Secretary Overturf made a motion to go into Executive Session pursuant to C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(C) relative to matter 15-245-D,. Board Member Greer seconded the motion, motion carried unanimously.

Motion: Secretary Overturf made a motion to come out of Executive Session, Board Member Greer seconded the motion, motion carried unanimously.

Office manager will contact Attorney General on case 15-245-D

Adjournment: Board Member Kuck made a motion to adjourn, Board Member Overturf seconded the motion, motion carried. Meeting ended at 2:55pm
