BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, March 23, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Nine appellants were present, four appellant failed to appear. The State Issuing Authority and eight local Issuing Authorities were present two failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Esq., James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck and Chief Carl Rosensweig.

Board Members Absent: Dr. Dike was absent.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Thirteen cases were heard in the following order:

1) Case No. 15-494-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

2) Case No. 15-470-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.  Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Secretary Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

3) Case No. 15-544-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear.. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

4) Case No. 16-105-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. An officer represented Chief Paul Fitzgerald, Berlin Police Department, at the hearing.

Motion: Board Member Kuck made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Greer, motion passed unanimously.

5) Case No. 15-504-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. No Issuing Authority appeared for Lt. Bunnell, Town of Uncasville.

Withdrawal: The appellant withdrew his appeal.

6) Case No. 15-478-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. There was a representative for Chief Scott Sansom, East Hartford Police.

Withdrawal: The appellant withdrew his appeal.

7) Case No. 15-333-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Ralph Sherman. Sgt. Cournoyer appeared as the Mansfield Resident Trooper for the town of Mansfield.

Decision: By majority decision, the Board decided to uphold the denial for the Local Issuing Authority. Secretary Overturf, and Board members Rosensweig, Greer and Ms. Johnson voted against the appellant and Chairman Blando and Board member Kuck voted in favor of the appellant

8) Case No. 16-132-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Wityak appeared for the local Issuing Authority, Acting Chief Anthony Campbell, New Haven Police Department.

Motion: Board Secretary Col. Overturf made a motion for the appellant. Board member Kuck seconded the motion, it passed unanimously,

9) Case No. 15-447-D involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Atty. Ralph Sherman .Lt. Charles Johnson appeared for the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Decision: By majority decision, the Board voted in favor of the appellant.. Chairman Blando, Secretary Overturf, and Board members Johnson and Kuck voted for the appellant and  Board member Greer and Chief Rosensweig voted against the appellant.

10) Case No. 17-264-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.. The local Issuing Authority, Chief Jeffry Cossette Meriden Police Department failed to appear.

Motion: Board Member Kuck made a motion to find for the appellant due to the Issuing Authority failing to appear seconded by Atty. Greer. The motion carried unanimously.

11) Case No. 16-087-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Off. Wityak appeared for the local Issuing Authority, Acting Chief Anthony Campbell, New Haven Police Department.

Motion: Board Member Kuck made a motion to find for the appellant due to the Issuing Authority failing to present evidence or facts that prove the appellant is unsuitable. Board Member Greer seconded the motion, motion carried unanimously.

12) Case No. 16-032-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Olson appeared for the local Issuing Authority, Chief Scott Sansom, East Hartford Police Department.

Motion: Board member Kuck made a motion for the appellant. Board member Johnson seconded the motion, it passed unanimously,

13) Case No. 16-107-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Charles Johnson appeared for the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Board member Overturf made a motion for the appellant. Board member Kuck seconded the motion, it passed unanimously,

Secretary’s Report:

Secretary Overturf made a motion to accept the March 9, 2017 minutes as submitted, Board Member Johnson seconded the motion, motion carried. Board Member Kuck abstained.

New Business: Discussion of tablets for the Board and other expenditures.  Laptop for agency.

Come up with language for letters going out for exhibits to go to both appellants and Issuing Authority at least 10 days prior to the hearing.

Change for policy and procedure for Acting Chairman not be an acting attorney.

Adjournment: Board Member Col. Overturf made a motion to adjourn, Board Member Kuck seconded the motion, motion carried. Meeting ended at 1:30pm.
