BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, September 10, 2015, 10am at the

Dept. of Emergency Services and Public Protection, Middletown, CT

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando, read the Introductory Statement and called the roll call. Seven appellants were present and one failed to appear. The State Issuing Authority was present and five local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Dr. Charles Dike, James A. Greer, Esq. and Mr. M. Peter Kuck.

Chairman Blando administered the oath to all witnesses.

Hearings: Eight cases were heard in the following order:

1) Case No. 14-538-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Joel Hurliman, Shelton Police Department.

Withdrawal: The appellant withdrew his appeal.

2) Case No. 14-348-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

3) Case No. 12-343-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 14-471-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Lovermi appeared for the local Issuing Authority, Chief Kevin Hale, Ansonia Police Department.

Decision: By a majority, the Board voted to uphold the decision of the local Issuing Authority, Chief Kevin Hale, Ansonia Police Department, the denial of a temporary pistol permit. Board Member Blando voted in favor of the appellant. Board Members Fishbein, Johnson, Overturf and Rosensweig voted in favor of the local Issuing Authority.

5) Case No. 14-415-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit.

6) Case No. 14-476-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Fishbein made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. Board Member Overturf seconded the motion, motion carried unanimously.

7) Case No. 14-533-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Deputy Chief Baraja appeared for the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department, with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief Joseph Gaudett, Bridgeport Police Department and ordered a temporary pistol permit to be issued.

8) Case No. 14-540-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Det. Lazzara appeared for the local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Decision: By a unanimous decision, the Board voted to overturn the decision of the local Issuing Authority, Chief John Salvatore, Monroe Police Department and ordered a temporary pistol permit to be issued.

Secretary’s Report:

1)     Board Secretary Fishbein made a motion to accept the August 27, 2015 minutes as written, Board Member Overturf seconded the motion, motion carried.

2)     Board Secretary Fishbein had a discussion with Board Members regarding the possibility of the Board meeting in Wallingford for the 2016 meetings.

Adjournment: Board Member Fishbein made a motion to adjourn, Board Member Johnson seconded the motion, motion carried. Meeting adjourned at 12:15pm.
