BOARD OF FIREARMS PERMIT EXAMINERS

Wednesday, November 4, 2015, 10am at the

Dept. of Emergency Services and Public Protection, Middletown, CT

Call to Order

Chairman Frank P. Blando, called the meeting to order at 10:00am.

Chairman Blando, read the Introductory Statement and called the roll call. Two appellants were present and four appellants failed to appear. The State Issuing Authority was present and three local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. Charles Dike, James A. Greer, II, Esq., Ms. Gudrun Johnson and Chief Carl Rosensweig.

Board Members Absent: Mr. M. Peter Kuck and Col. Kyle Overturf

Hearings: Nine cases were heard in the following order:

1) Case No. 14-504-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Joseph Roden, Resident Trooper represented the local Issuing Authority, First Selectman William Butterly, Town of Woodbury.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, First Selectman William Butterly, Town of Woodbury, the denial of a temporary pistol permit.

2) Case No. 14-097-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf with one witness. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit, at this time.

3) Case No. 14-090-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Motion: Board Member Fishbein made a motion in favor of the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department, by default, due to the appellant’s failure to appear. Motion seconded by Board Member Rosensweig, motion carried unanimously.

4) Case No. 14-153-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department.

Motion: Board Member Fishbein made a motion in favor of the local Issuing Authority, Chief Paul Hammick, Bloomfield Police Department, by default, due to the appellant’s failure to appear. Motion seconded by Board Member Rosensweig, motion carried unanimously.

5) Case No. 14-171-SD, involving the denial of a State pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone appeared for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Fishbein made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. Motion seconded by Board Member Johnson, motion carried unanimously.

6) Case No. 14-042-R, involving the revocation of his State pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone appeared for the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Member Fishbein made a motion in favor of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, by default, due to the appellant’s failure to appear. Motion seconded by Board Member Rosensweig, motion carried unanimously.

Secretary’s Report:

Board Secretary Fishbein made a motion to accept the October 21, 2015 minutes as written, Johnson seconded the motion, motion carried. Board Members Dike, Greer and Rosensweig abstained.

New Business: Board Secretary spoke about the re-election of the Board Secretary at the December 10, 2015 meeting.

Adjournment: Fishbein made a motion to adjourn, Rosensweig seconded the motion, motion carried.
