BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Chairman Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call. 8 appellants were present and 1 absent. The State Issuing Authority was present and 2 local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Craig C. Fishbein, Esq., Dr. S. David Bernstein*, James A. Greer, Esq., Ms. Gudrun Johnson, Mr. M. Peter Kuck, Col. Kyle Overturf*and Chief Carl Rosensweig.

Chairman Blando administered the oath to all witnesses.

Hearings:

1) Case No. 13-561-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Chief Michael Kehoe, Newtown Police Department, appeared as the local Issuing Authority.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Michael Kehoe, Newtown Police Department, the denial of a temporary pistol permit.

2) Case No. 13-693-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Resident Trooper Eric Kelley represented the local Issuing Authority, First Selectman Jon Brayshaw, Town of Middlefield.

Motion: Secretary Fishbein made a motion to accept an agreement between the appellant and the local Issuing Authority, First Selectman Jon Brayshaw, Town of Middlefield, the appellant would withdraw his appeal and the local Issuing Authority would issue the temporary pistol permit. Kuck seconded the motion, motion carried.

3) Case No. 13-474-R, involving the revocation of her pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with three witnesses.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit, at this time.

4) Case No. 13-440-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit, at this time.

5) Case No. 13-701-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Motion: Secretary Fishbein made a motion to continue the case to June 12, 2014 in Wethersfield. Kuck seconded the motion.  Following a discussion Fishbein accepted Chairman Blando’s friendly amendment to change the date to continue Case 13-701-R to May 22, 2014. Kuck seconded the motion with the friendly amendment to continue the case to May 22, 2014, motion carried unanimously.

6) Case No. 13-514-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Mitchell Lake appeared for the appellant however the appellant failed to appear. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Overturf made a motion to default the case due to the appellant’s failure to appear. Kuck seconded the motion. Motion carried 7 in favor and 1 against. Bernstein, Fishbein, Greer, Johnson, Kuck, Overturf and Rosensweig voted in favor of the motion. Blando voted against the motion.

7) Case No. 13-462-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, and ordered the State pistol permit be reinstated.

*Members Bernstein and Overturf left due to professional commitments.

8) Case No. 13-441-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Frank Canace represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to overturn the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, and ordered the State pistol permit be reinstated.

9) Case No. 13-477-R, involving the revocation of his pistol permit to carry pistols and revolvers. Attorney Timothy R. Cummings represented the appellant. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority, 4-2, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the appellant’s pistol permit. Blando and Fishbein voted in favor of the appellant. Greer, Johnson, Kuck, and Rosensweig voted for the State Issuing Authority.

Secretary’s Report:

Secretary Fishbein made a motion to accept the April 24, 2014 minutes as written, Rosensweig seconded the motion, motion carried.
