BOARD OF FIREARMS PERMIT EXAMINERS

Call to Order

Acting Chairman Craig Fishbein called the meeting to order at 10:00am.

Chairman Fishbein read the Introductory Statement and called the roll call. 6 appellants were present and 3 absent. The State Issuing Authority was present and 5 local Issuing Authorities were present.

Board Members Present: Secretary Craig C. Fishbein, Esq., Dr. S. David Bernstein, James A. Greer, Esq., Ms. Gudrun Johnson, Col. Kyle Overturf and Chief Carl Rosensweig.

Board Members Absent: Chairman Frank P. Blando, Esq. and Mr. M. Peter Kuck.

Chairman Fishbein administered the oath to all witnesses.

Hearings:

1) Case No. 14-169-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Ash represented the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the local Issuing Authority, Chief Shawn Boyne, New Milford Police Department, the denial of a temporary pistol permit.

2) Case No. 14-067-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers and the local Issuing Authority Chief Shawn Boyne, New Milford Police Department.

Agreement: The Board’s staff was notified on May 21, 2014 that appellant withdrew his appeal and the local Authority, Chief Shawn Boyne, New Milford Police Department had issued the temporary pistol.

3) Case No. 14-130-SD, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

4) Case No. 14-183-SD,involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Withdrawal: The appellant withdrew his appeal.

5) Case No. 13-701-R, involving the revocation of his pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Paolo D’Alessandro represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with one witness.

Decision: By a unanimous decision, the Board voted to uphold the decision of the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection, the revocation of the pistol permit, at this time.

6) Case No. 14-011-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. A representative appeared for the local Issuing Authority, Chief Michael Surprenant, Plainfield Police Department.

Withdrawal: The appellant withdrew his appeal.

7) Case No.  14-118-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief Matthew Reed, South Windsor Police Department.

Motion: Acting Chairman Fishbein called for a motion to find for the local Issuing Authority, by default, due to appellant’s failure to appear. Rosensweig made the motion, Overturf seconded the motion, motion carried.

8) Case No. 14-180-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Atty. John D. Bowdren represented the appellant. Lt. Kevin Glenn appeared for the local Issuing Authority, Chief Michael Surprenant, Plainfield Police Department.

Motion: Acting Chairman Fishbein called for a motion to accept the agreement between the local Issuing Authority and the appellant. Overturf made a motion to accept the agreement that the local Issuing Authority, Plainfield Police Department agreed to issue the pistol permit and the appellant agreed to withdraw the appeal. Greer seconded the motion, motion carried.

9) Case No. 14-149-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. A representative appeared for the local Issuing Authority, Chief John Salvatore, Monroe Police Department.

Motion: Acting Chairman Fishbein called for a motion to find for the local Issuing Authority, by default, due to appellant’s failure to appear. Rosensweig made the motion, Overturf seconded the motion, motion carried.

Secretary’s Report:

Fishbein called for a motion to accept the May 8, 2014 minutes as written, Johnson made the motion, Greer seconded the motion, motion carried.

New Business: Fishbein reported that 6 months of cases were reviewed by members Overturf and Fishbein due to the Board’s backlog. As a result 22 cases were scheduled for the hearing; 12 cases were resolved prior to hearing, 9 cases were scheduled for the hearing and 1 case was continued to a new hearing date.

Adjournment: Johnson made a motion to adjourn, Overturf seconded the motion, motion carried. Meeting adjourned at 12:45pm.
