What happens if state employees are not in compliance with the executive order?

State hospital employees who continue to not be in compliance will be subject to being placed on a leave of absence without pay, position not held, prior to separation from State Service. More information about what a leave of absence without pay entails: 

  • A leave of absence without pay “position not held” means your agency can initiate refilling your position while you are on leave.
  • You will not be paid.
  • You will not be permitted to use your accrued leave to be paid.
  • Periods of unpaid leave are not credited to your service time. This includes qualifying for retirement, and may impact your seniority.
  • After five (5) consecutive days, the leave will impact your monthly accrued sick and vacation leave.
  • After five (5) consecutive days, you will be required to pay both your health insurance premiums and the State’s portion of your health insurance.
  • You may not qualify for unemployment due to deliberate violation.
