BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, July 9, 2020, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:00am.

Chairman Blando read the Introductory Statement and called the roll call.  Four appellants were present, two appellants failed to appear. The State Issuing Authority and one Local Issuing Authorities were present and one failed to appear.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf, Carolyn Futtner Esq., Anthony Iaconis, Esq., Gudrun Johnson, and Mr. M. Peter Kuck.

Board Members Absent: Dr. Cynthia Conrad and Chief Carl Rosensweig

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: Six cases were heard in the following order:

1) Case No. 19-252-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Kyle Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

2) Case No. 19-057-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection.

Motion: Board Secretary Kyle Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

3) Case No. 19-100-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Jon L. Schoenhorn, Esq. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By majority decision, the Board voted to uphold the decision of the State Issuing Authority, the revocation of the pistol permit. Chairman Blando, Secretary Overturf, Atty. Futtner and Ms. Johnson voted in favor of the State Issuing Authority.  Atty. Iaconis and Mr. Kuck voted in favor of the Appellant.

4) Case No. 20-398-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant was represented by Ralph D. Sherman, Esq.   No one appeared for the Local Issuing Authority, Chief James Heavey, Greenwich Police Department.

Motion: Board Secretary Kyle Overturf made a motion for the appellant by default, due to the Local Issuing Authority failing to appear, seconded by Ms. Johnson.

5) Case No. 20-257-R-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Lt. Heather Desmond represented the Local Issuing Authority, Chief William McKenna, Middletown Police Department.

Decision: By a unanimous decision, the Board voted in favor of the Local Issuing Authority the denial of her pistol permit. 

6) Case No. 20-307-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant was represented by Noah J. Kores, Esq.. Trp. Doug Sauve represented the State Issuing Authority, Commissioner James C. Rovella, Department of Emergency Services and Public Protection with one witness.

Decision: By a majority decision, the Board voted in favor of the State Issuing Authority the revocation of his pistol permit at this time.  Chairman Blando, Secretary Overturf, Atty. Futtner, Atty. Iaconis and Ms. Johnson voted for the State Issuing Authority. Mr. Kuck voted in favor of the Appellant. 

1:35pm – Carolyn Futtner left the hearing.

Secretary’s Report:

Board Secretary Overturf made a motion to accept the minutes from March 5, 2020, seconded by Ms. Johnson, motion carried. Atty Futtner did not vote.

 

Old Business: Review of the cancelled June 18, 2020 hearing.

 

 

Adjournment: Atty. Iaconis made a motion to adjourn, seconded by Board Secretary Overturf, motion carried. Meeting ended at 1:40pm.
