BOARD OF FIREARMS PERMIT EXAMINERS

Thursday, January 26, 2017, 10am at the

Wethersfield Police Department, 250 Silas Deane Hwy.

Call to Order

Chairman Frank P. Blando called the meeting to order at 10:06am.

Chairman Blando read the Introductory Statement and called the roll call.  6 appellants were present, 4 appellant failed to appear. The State Issuing Authority and 8 local Issuing Authorities were present.

Board Members Present: Chairman Frank P. Blando, Esq., Secretary Col. Kyle Overturf., Dr. Charles Dike, Ms. Gudrun Johnson, and Chief Rosensweig.

Board Members Absent: Atty. Greer and Mr. Kuck were absent.

Chairman Frank P. Blando administered the oath to all witnesses.

Hearings: 10 cases were heard in the following order:

1) Case No. 17-114-CD, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Officer Hawes represented the local Issuing Authority, First Selectman Mark Walter, Town of East Haddam.

Continued: Case continued until March 23rd hearing.

2) Case No. 16-089-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Chief Mark Palmer appeared for the local Issuing Authority, Coventry Police Department.

Motion: Board Secretary Col. Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

3) Case No. 15-354-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant failed to appear. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection.

Motion: Board Secretary Col. Overturf made a motion for the State Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

4) Case No. 15-447-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. Attorney Ralph Sherman represented the appellant. Lt. Charles Johnson represented the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Continued: Case continued until March 9th hearing.

5) Case No. 15-404-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear. Lt. Charles Johnson appeared for the local Issuing Authority, Chief Armando Perez, Bridgeport Police Department.

Motion: Board Secretary Col. Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

6) Case No. 15-235-R, involving the revocation of a pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Sgt. Alex Giannone represented the State Issuing Authority, Commissioner Dora B. Schriro, Department of Emergency Services and Public Protection with two witnesses.

Withdraw: Appellant chose to withdraw his case.

7) Case No. 15-386-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf.   Lt. Golding represented the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Withdraw: Appellant chose to withdraw his case.

8) Case No. 16-024-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant failed to appear.. Lt. Golding represented the local Issuing Authority, Chief Michael Lombardo, Trumbull Police Department.

Motion: Board Secretary Col. Overturf made a motion for the local Issuing Authority, by default, due to the appellant failing to appear. Motion was seconded by Board Member Johnson, motion passed unanimously.

9) Case No. 16-064-D, involving the denial of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on her own behalf. Ofc, James McKeown represented the local Issuing Authority, Chief Paul Melanson, Farmington Police Department.

Decision: By unanimous decision, the Board decided to uphold the denial for the Local Issuing Authority.

10) Case No. 17-188-CD,  involving the pending decision of a temporary pistol permit to carry pistols and revolvers. The appellant appeared on his own behalf. Lt. Suski represented the local Issuing Authority, Chief John Daly, Southington Police Department with 1 witness.

Decision: By majority decision, the Board decided to uphold the denial for the Local Issuing Authority. Secretary Overturf, and Board members Chief Rosensweig and Dr. Dike voted against the appellant and Chairman Blando and Board member Johnson voted in favor of the appellant.

Secretary’s Report:

Secretary Overturf made a motion to accept the January 12, 2017 minutes as submitted, Board Member Johnson seconded the motion, motion carried. Board Member Dike abstained.

Motion: Secretary Overturf made a motion to go into Executive Session pursuant to C.G.S. 1-200(6), C.G.S. 1-200(8), and C.G.S. 1-200(9)(C) relative to matter 15-068-R. Board Member Johnson seconded the motion, motion carried unanimously.

Motion: Secretary Overturf made a motion to come out of Executive Session, Board Member Johnson seconded the motion, motion carried unanimously.

The Board agreed to rehear Case No. 15-068-R, on March 9, 2017 provided the Board has a quorum.

Adjournment: Board Member Dike made a motion to adjourn, Board Member Overturf seconded the motion, motion carried. Meeting ended at 1:12
