You have asked two related questions about the State Employee Campaign for Charitable Giving (the "campaign"), which is an annual campaign "to raise funds from state employees for charitable and public health, welfare, environmental, conservation and services purposes." Conn. Gen. Stat. § 5-262(a)(3). Specifically, you ask whether the State Employee Campaign Committee (the "Committee") may prohibit a federation1 from participating in the campaign if one or more of the federation's member agencies solicits from state employees during the designated campaign period other than through the campaign. You have also asked whether the Committee may require a federation that seeks to participate in the campaign to certify to the Committee that it will refrain from soliciting charitable contributions from state employees during the designated campaign period other than through the campaign.

You ask us whether the Division of Special Revenue (DOSR) may approve a contract between Autotote Enterprises, Inc., the licensee of the Connecticut Off-Track Betting System, and Wyvern International, Ltd., which would provide for simulcasting and common pool wagering on thoroughbred races in Australia pursuant to Conn. We are writing in response to your letter dated February 22, 1990, in which you request our advice about the constitutionality of the residency requirements and waiting periods contained in Conn. Gen. Stat. ee 27-103 and 27-122b, two state statutes concerning veterans' benefits. We are also responding to your oral request, based upon your responsibilities under Conn. Gen. Stat. e27- 102l(c)(4),1 for our opinion on the constitutionality of the residency requirement found in Conn. Gen. Stat. e 27-104, which is contained in Part II of Chapter 506.

In your letter of March 15, 1994, you indicate that in two lawsuits, Kennedy St. George v. Mak, Case No. 5:92-CV-00587(JAC), United States District Court, District of Connecticut, and Lewis v. Mak, Case No. 5:92-CV-00593(JAC), United States District Court, District of Connecticut, the Attorney General's Office has advised the High Sheriff of Fairfield County and several persons in his department that it would be inappropriate for the Attorney General's Office to continue to represent them in those cases. Consequently, on behalf of the Sheriffs' Advisory Board you have asked for legal advice on the following question: Does the Sheriff's Advisory Board have authority to appropriate funds for the defense of sheriffs, deputy sheriffs and special deputy sheriffs in lawsuits brought against them in their individual capacities after the Attorney General has determined that providing a defense would be inappropriate pursuant to Conn. This is in response to your request for advice regarding access to nursing home facilities by patient advocates and ombudsmen. You have asked the following questions: 1. Does an Ombudsman/Patient Advocate have access to a facility to visit, observe conditions and operation only in response to a specific complaint? 2. Must an Ombudsman/Patient Advocate notify the administration or staff of the reason for their presence? 3. Can a facility require that a schedule including date and time of visits be posted with the intent of limiting access? 4. May a facility announce the presence of the Ombudsman/Patient Advocate over the PA system? 5. Can the facility require that a staff person accompany the Ombudsman/Patient Advocate? 6. Can the facility refuse to send an Accident and Incident or A500 report to the Ombudsman Office?
